Green Cap Health, LLC (“Green Cap Health,” “Green Cap,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy explains how we collect, use, share, and protect information when you visit greencaphealth.com (the “Site”), use our patient portal, book a consultation, receive treatment, or communicate with us (together, the “Services”).
This policy should be read together with our Terms & Conditions. By using the Services, you acknowledge this Privacy Policy. If you need this policy in an alternative format due to a disability, contact us using the details in Section 13.

1. Health Information and HIPAA
Green Cap Health connects patients with independent, Texas-licensed healthcare providers (“Providers”) and state-licensed pharmacy partners. Health information you share for care, such as intake answers, medical history, medications, lab results, photos, and Provider notes, may be “protected health information” (“PHI”) under the Health Insurance Portability and Accountability Act (“HIPAA”) and “protected health information” under the Texas Medical Records Privacy Act (Tex. Health & Safety Code ch. 181).
We use and disclose PHI only as permitted by HIPAA, Texas law, and the Notice of Privacy Practices provided by your Providers. Where we act on behalf of Providers or pharmacies, we do so under business associate agreements. We do not sell your health information, and we do not use it for marketing without your written authorization. Information that is not PHI (for example, general Site browsing data) is handled as described in the rest of this policy.
2. Information We Collect
Information you provide:
- Identity and contact: name, date of birth, sex, email, phone number, and shipping and billing address.
- Health information: intake questionnaire answers, medical history, current medications, allergies, height and weight, lab results, photos you upload (for example, for hair or skin evaluations), and messages with your care team.
- Verification: government-issued ID and related details used to confirm your identity, age, and Texas location.
- Payment: card details, processed by our third-party payment processor (see Section 7).
- Communications: contact-form submissions, emails, calls, chat, and SMS consent records.
Information collected automatically: IP address, device and browser type, operating system, pages viewed, referring URLs, and time spent on the Site, collected through cookies and similar technologies (see Section 6).
Information from others: Providers, pharmacy partners, laboratories, identity-verification services, and our patient-portal provider (Practice Better) may share information with us as needed to deliver your care.
3. How We Use Information
- To schedule consultations and enable Providers to evaluate and treat you;
- To send prescriptions to pharmacy partners and coordinate shipping;
- To create and manage your patient portal account;
- To process payments and subscriptions;
- To verify your identity, age, and eligibility;
- To send appointment reminders, prescription and shipping updates, and account notices;
- To respond to your questions and provide customer support;
- To send promotional communications where you have opted in (never using PHI without authorization);
- To operate, secure, and improve the Site and Services;
- To comply with legal, regulatory, and medical recordkeeping obligations, and to prevent fraud.
4. How We Share Information
We do not sell or rent your personal information. We share information only as follows:
- Providers: independent Texas-licensed clinicians who evaluate and treat you.
- Pharmacy partners: state-licensed pharmacies that fill and ship your prescriptions.
- Service providers: vendors that help us operate, such as our patient-portal platform (Practice Better), payment processors, laboratories, identity-verification services, shipping carriers, email and SMS providers, and IT hosting. They may use information only to perform services for us and must protect it.
- Legal and safety: when required by law, subpoena, or court order; to report as required to public health authorities; or to protect the rights, safety, or property of patients, Green Cap Health, or others.
- Business transfers: in connection with a merger, acquisition, or sale of assets, subject to this policy and applicable law. We will notify you of any change in ownership affecting your information.
- With your consent: for any other purpose you authorize.
We may share de-identified or aggregated data that cannot reasonably be used to identify you.
5. SMS / Text Messaging and Mobile Information
If you opt in, Green Cap Health may send you appointment reminders, prescription and refill updates, shipping and account notifications, customer-care responses, and (only if you separately opt in) promotional offers. Transactional and promotional consents are separate. Consent is not a condition of purchase.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to opt out at any time. Reply HELP for help, or contact support@greencaphealth.com or (832) 648-2801.
- Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We keep your mobile number, opt-in date and time, and message history only to deliver the messaging service you requested and to document your consent. Please tell us if your phone number changes.
6. Cookies, Analytics, and Advertising
We use cookies and similar technologies to keep the Site working, remember preferences, and understand how visitors use the Site. We may use analytics and advertising tools (such as Google Analytics and Meta) on public, non-authenticated pages of the Site.
We do not place advertising or analytics tracking technologies on our patient portal, intake forms, or any page where you enter health information, and we do not share PHI with advertising platforms.
You can control cookies through your browser settings, opt out of Google Analytics at tools.google.com/dlpage/gaoptout, manage Google ad settings at adssettings.google.com, and learn about interest-based advertising choices at optout.aboutads.info. Disabling cookies may affect some Site features.
7. Payment Information
Card payments are handled by PCI-compliant third-party payment processors. We do not store your full card number on our servers. Your payment information is subject to the processor’s privacy and security practices.
8. Data Security
We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and at rest, HIPAA-compliant systems, role-based access limited to staff and vendors who need it, and secure SSL connections across the Site. No system is 100% secure, and we cannot guarantee absolute security. Protect your portal password and contact us immediately if you suspect unauthorized access.
If a breach affecting your information occurs, we will notify you and the appropriate authorities as required by HIPAA and Texas law (Tex. Bus. & Com. Code § 521.053).
9. Data Retention
We keep information for as long as needed to provide the Services and to meet legal obligations. Medical records are retained for the periods required under Texas law and Texas Medical Board rules. Other information is retained only as long as reasonably necessary for the purposes described in this policy, then deleted or de-identified.
10. Your Choices and Rights
All patients may:
- Request access to or a copy of your information and medical records;
- Request correction of inaccurate information;
- Request deletion of information, subject to medical-record retention and other legal requirements;
- Unsubscribe from marketing emails using the link in any email, or reply STOP to texts;
- Withdraw any consent you previously gave, going forward.
HIPAA rights. For PHI, you may have additional rights (such as requesting restrictions or an accounting of disclosures) as described in your Providers’ Notice of Privacy Practices.
Texas residents. Under the Texas Data Privacy and Security Act, to the extent it applies, you may request to confirm, access, correct, delete, or obtain a portable copy of your personal data, and to opt out of targeted advertising, the sale of personal data, and profiling. We do not sell personal data, and we process sensitive data (including health data) only with your consent or as permitted by law. If we deny your request, you may appeal by replying to our decision; if the appeal is denied, you may contact the Texas Attorney General at texasattorneygeneral.gov.
To make a request, email support@greencaphealth.com or call (832) 648-2801. We will verify your identity before acting and respond within 45 days (or as required by law). We will not discriminate against you for exercising your rights.
11. Children’s Privacy
Our Services are only for adults 18 and older. We do not knowingly collect information from anyone under 18. If we learn that we have, we will delete it.
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version here with a new “Last Updated” date and notify you by email or through the portal of material changes. We will not use your information in a materially different way without your consent where required by law.

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular CA User or device (“personal information”). Personal information does not include:
- Publicly available information from government records.
- De-identified or aggregated CA User information.
- Information excluded from the CCPA’s scope, such as:
- health or medical information covered by HIPAA and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; and
- personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.
We obtain the categories of personal information listed above from the following categories of sources (with the specific categories of personal information indicated in parenthesis):
- Directly from our CA Users. For example, from online registration forms that our CA Users submit to us in connection with the products and/or services that we offer by and through the Site. (Categories A, B, C, D and E)
- Indirectly from our CA Users. For example, through information we collect from our CA Users in the course of providing our products and/or services to them. (Categories A, B, C, D, E and F)
- Directly and indirectly from activity on the Site. This includes the type of browser that the CA User uses (e.g., Safari, Chrome, Internet Explorer), CA User IP address, the type of operating system used by the CA User (e.g., Windows or iOS) and the domain name of the CA User’s Internet Service Provider. In addition, we obtain certain Site usage details and analytics as same are collected automatically by us and our third-party partners. (Category F)
- When our CA Users interact with us on our social media accounts, including commenting on and/or liking our posts. (Categories A, B, C, D, E and F)
- From third parties that interact with us in connection with the products and/or services that we offer to our CA Users. For example, third party entities that assist us in sending direct and electronic mail, removing duplicate information from CA User lists, analyzing data, and providing marketing analysis. (Categories A, B, C, D, E and F)
Use of Personal Information
Subject to your right to limit our ability to use the sensitive personal information that we collect from you, we may use or disclose the personal information that we collect (including: (a) name; (b) mailing/billing address; (c) e-mail address; (d) telephone number; (e) your gender; (f) credit card information (where purchasing Products and Services); and (g) answers to health and well-being related questions, as asked via the medical intake form) for one or more of the following business purposes (with the specific categories of personal information indicated in parenthesis):
- To fulfill or meet the reason for which the information is provided. For example, if you provide us with personal information in connection with your request for products and/or services, we will use that information to process your request. (Categories A, B, C, D, E and F)
- To provide you with information, products, or services that you request from us. (Categories A, B, C, D, E and F)
- To create, maintain, customize, and secure your account with us. (Categories A, B, C, D, E and F)
- To provide you with e-mail, direct mail and telemarketing messages concerning certain Green Cap, Inc. products and/or services, as well as third-party products and/or services, that we believe may be of interest to you. (Categories A, B, C, D, E and F)
- To deliver relevant Site content and advertisements to you and measure or understand the effectiveness of the advertising we serve to you. (Categories A, B, C, D, E and F)
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including the Site’s Terms and Conditions. (Categories A, B, C, D, E and F)

- To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred. We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you with notice.
Sharing Personal Information
Subject to your right to opt-out of such sharing/sale, we may share your personal information (including: (a) name; (b) mailing/billing address; (c) e-mail address; (d) telephone number; (e) your gender; (f) credit card information (where purchasing Products and Services); and (g) answers to health and well-being related questions, as asked via the medical intake form) for the business purposes set forth above.
When we disclose personal information to a third-party service provider or other entity, we enter into a contractual relationship that describes the purpose for which such third party may use the personal information and requires that third party to both keep the personal information confidential and not use it for any purpose other than the performance of its services under the applicable contract. Please note, we do not collect information from CA Users that we actually know are less than eighteen (18) years of age and we do not share or sell the personal information of CA Users that we actually know are less than eighteen (18) years of age. Without limiting the foregoing, we have not shared or sold the personal information of CA Users that we actually know are less than sixteen (16) years of age in the preceding twelve (12) months.
In the preceding twelve (12) months, we have disclosed the following categories of personal information (including: (a) name; (b) mailing/billing address; (c) e-mail address; (e) telephone number; (f) your gender; (g) credit card information (where purchasing Products and Services); and (h) answers to health and well-being related questions, as asked via the medical intake form) for a business purpose :

Retention of Personal Information
Green Cap may retain the categories of personal information set forth below for the period that is the greater of: (a) as long as Green Cap believes necessary; (b) as long as necessary to comply with Green Cap’s legal obligations, resolve disputes and/or enforce its agreements; and/or (c) as long as needed to provide CA Users with the products and/or services requested by such CA Users on the Site:

Green Cap may dispose of or delete any such information at any time, except as required by law, or as otherwise restricted by the terms and conditions set forth in any other agreement or document that is binding upon Green Cap.

Opt-Out from the Use and/or Sharing of Your Sensitive Personal Information
You have the right to limit our use of your sensitive personal information, including any sensitive information from Category B (California Customer Records personal information), Category C (Protected classification characteristics under California or federal law) and/or Category E (Biometric information), to those uses which: (i) are necessary to perform the services or provide the goods requested by you; (ii) help us to ensure security and integrity of your personal information to the extent the use of your sensitive personal information is reasonably necessary and proportionate for these purposes; (iii) are short-term, transient uses including, but not limited to, non-personalized advertising shown as part of your then-current interaction with the Site, provided that your personal information is not disclosed to another third party and is not used to build a profile about you or otherwise alter your experience outside the then-current interaction with the Site; (iv) involve performing services on behalf of Green Cap™, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of Green Cap ™; and (v) include activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by, Green Cap ™, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by, Green Cap ™.
You also have the right opt-out of our sharing your sensitive personal information with third parties, including any sensitive information from Category B (California Customer Records personal information), Category C (Protected classification characteristics under California or federal law) and/or Category E (Biometric information).

Access to Specific Information and Data Portability Rights
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable CA User request, we will disclose to you:
- The categories of personal information we collected about you.
- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting or selling that personal information.
- The categories of third parties with whom we have shared that personal information.
- The specific pieces of personal information we collected about you (also called a data portability request).
- If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
- sales, identifying the personal information categories that each category of recipient purchased; and
- disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
Deletion Request Rights
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable CA User request, we will delete (and direct our service providers to delete) your personal information from our (their) records, unless an exception applies; provided, however, that in some cases, strictly for regulatory compliance purposes and to better evidence/honor opt-out/unsubscribe requests (and for no other purposes), we may retain certain items of your personal information on a de-identified and aggregated basis in such a manner that the data no longer identifies you.
We may deny your deletion request if retaining the information is necessary for us or our service providers to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our obligations in connection with our contract/relationship with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech rights, ensure the right of another CA User to exercise her/his free speech rights or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, but only if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with CA User expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Access, Data Portability and Deletion Rights
To exercise your access, data portability and/or deletion rights described above, please submit a verifiable CA User request to us by either:

- Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable CA User request related to your personal information.
You may only make a verifiable CA User request for access or data portability twice within a 12-month period. The verifiable CA User request must:
- Provide sufficient information that allows us to reasonably verify that you are: (1) the person about whom we collected personal information; or (2) an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable CA User request does not require that you create an account with us. We will only use personal information provided in a verifiable CA User request to verify the requestor’s identity or authority to make the request.
Response Timing and Format
We endeavor to respond to all verifiable CA User requests within forty-five (45) days of the receipt thereof. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures that we provide will only cover the twelve (12) month period preceding the receipt of your verifiable request. The response that we provide will also explain the reasons that we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable CA User request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services;
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
- Provide you a different level or quality of goods or services; and/or
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
Changes to these Privacy Provisions
We reserve the right to amend these Privacy Provisions in our discretion and at any time. When we make changes to these Privacy Provisions, we will notify you by email or through a notice on the Site’s homepage.
